Revised Constitution of the Association of Nigerian Residents in uMthlathuze Municipality, 2010
Section 1: Name of the Association
a. The name of Association shall be Association of Nigerians Resident in uMhlathuze
Municipality and shall hereafter be referred to as the Association.
b.The general body of the Association shall be referred to as the House.
Sub-section 1: Objectives of the Association
a. To know ourselves and provide a networking forum for Nigerians.
b. To identify with the needs of one another and find ways of assisting where possible.
c. Provide a moral voice in the event that any member engages in misconduct that brings the name of Nigeria to disrepute.
d. To constitute a contact point for Nigeria’s issues.
e. To be in touch with other Nigerians within South Africa and other Nigerians in Diaspora.
f. To be in touch with the Nigerian Consulate.
g. To render community service to our immediate environment.
Sub-section 2: Membership
a. Membership of the Association shall be open to all Nigerians (including Nigerians
with non- Nigerian spouses) living or working in uMhlathuze Municipality.
b. Membership shall be effected through formal registration and payment of annual membership fees.
c. Each family/member shall, however, fill one membership form.
d. A above does not preclude Nigerians outside the Municipality who may want to be members of the Association.
Sub-section 3: Types of membership
a. Associate/Honorary membership shall can be conferred on non-Nigerians who the
Association deems fit of such conferment.
b. Life membership can also be conferred on deserving members who are leaving the Municipality or South Africa.
c. Associate/Honorary/Life members do not however have voting rights and privileges.
Sub-section 4: Membership levy/fees
a. It is agreed that there should be an annual membership levy for the smooth running of the body.
b. Each family will pay an annual fee of R600 subject to review by the general House
c An Individual (person without a family here) will pay an annual fee of R360.
d. Levies could be paid in installments but must be fully paid by July of every year
e. A member who is not employed or does not have a source of income will be excluded
from the levy regime until such a person secures employment.
f. The levy for such a person shall take effect from the month he/she secures employment.
Sub-section 5: Basis for levy
a. To run the Association.
b. Subsidizing any trip made by any member on behalf of the Association within South
Africa whenever the need arises.
c. Social events in member’s family e.g. birth of a child, marriage, funeral, ownership of
a house etc. as advised by the Welfare Committee guided by the Welfare Bye-laws
d. To support members in emergency needs as defined by the Welfare bye-laws.
e. And such other expenses that would be determined by the House.
Sub-section 6: Cessation of membership
a. Anyone shall cease to be a member of the Association either voluntarily or involuntarily as decided by the House if found guilty of:-
- Unexplained absence from four consecutive meetings of the Association.
- If such a member is convicted by a competent court of law for crime.
b. Any employed member who fails to pay his/her levy for one year shall lose his/her membership.
c. This shall be only after a letter of appeal from the Association to the individual(s) to seek a change of heart has been made.
d. Such termination of membership shall thereafter be communicated in a final letter of notice to that effect.
e. Sub-sections b and c shall also apply to a above.
Section 2: Meetings of the Association
a. Meetings shall be bimonthly and on the last Sunday of the month.
b. All meeting should be modest and not extravagant.
c. Meetings should not last more than 2 hours.
d. Quorum for any meeting of the House shall be 30% of registered members.
Section 3: Officers/Executive body of the Association
a. President- The President shall preside over meetings and generally provide leadership for the Association.
b. Vice President- Shall stand in for the President when she/he is away.
c. Secretary- Shall be the custodian of all records of the Association and handles all correspondences.
d.Assistant Secretary - Shall assist the secretary in his/her duties and act in his/her absence.
e. Financial Secretary/Treasurer- Takes custody of all monthly levies and financial transactions of the Association.
f. Public Relations Officer-Shall be in charge of publicity, information gathering and Association/community relations.
g. The immediate past president shall be an ex-officio member of the executive.
h. At the end of the tenure of an executive committee, they shall be collectively appreciated for their work unless
deemed otherwise by the general House.
Sub-section 1: Tenure of office
a. All elected officers shall serve a mandatory two-year term, and can be re-elected for another term of two years
after which they will not be eligible to serve in the same portfolio for a third term unless another 2 years has passed.
Sub-section 2: Financial Administration
a.The Executive shall keep an imprest account for running the activities of the Association. The amount shall be
determined by the House from time to time.
Sub-section 3: Impeachment
a. Impeachment of any member of the executive from office shall be only by two-thirds of members present at a
regular meeting of the House.
b. This shall only be after a disciplinary committee set up to investigate wrongdoing has so recommended.
c. Impeachable offenses or wrongdoing shall include breach of code of conduct as stipulated in Section 6; breach of
Section 1, sub-section 6(a) and any other behavior that will bring the Association to disrepute.
Section 4: Elections
b. Elections shall be held at the November meeting of every election year. If for any reason elections cannot be
held at this meeting, then it must be held within three months from then (December to February).
c. New officers so elected will resume office in January of the following year.
d. All members wishing to contest elections of the Association must be in good standing; financial and attendance
at regular meetings.
e. For an election to be deemed valid, 50% of registered members of the Association shall be present.
f. Every registered member is eligible to vote and be voted for.
Section 5: Account of the Association and its Signatories
a. The Association shall operate a savings account. A cheque and or investment account could be opened if members deem
fit at any time.
b. The Bank shall be………………………………………………………………………...
c.The decision to open any account for the Association shall be made by simple majority of members present in a meeting.
d.The signatories to the account shall be the President, the treasurer and any member of the Association who shall be
elected/appointed from the house.
e. Any two of the above can sign at any given time to effect a financial transaction on behalf of the Association.
f. The financial year of the Association shall be from January to December.
g. The financial account of the Association shall be rendered by the Financial Secretary/Treasurer to the House
at the end of every financial year.
Section 6: Code of conduct of members
a. Members must attend meetings regularly.
b. Members shall attain up to a minimum of 50% attendance of meetings in any given year to be in good standing as a member.
c. Absenteeism without apologies may attract a fine of R20.
d. Prolonged absenteeism of eight months (4 consecutive meetings) and over without apologies constitutes enough
ground for suspension of membership.
e. A committee should be set up to investigate each offence on its merit whenever a member breaches the Law of
South Africa and is thereafter pronounced guilty.
f. Any member found guilty by the committee shall then have his/her membership reviewed.
g. All membership levies should be paid up latest July 31 of every year.
h.A single family member (husband or wife) can give apology on behalf of his/her spouse for any given meeting of the Association.
i. All apologies must be made to a member of the executive and this must be made latest an hour before the start of the meeting.
Section 7: Welfare
a. The Association shall provide welfare assistance to registered members as provided for in the Welfare Bye-laws of the Association.
Section 8: Committees of the Association
a. The Association shall establish and maintain the following standing committees to facilitate its smooth running and to
meet its stated objectives:
- Welfare Committee
- Investment Committee
- Socials and Community Outreach Committee
- Independence Day Committee
- Membership Committee
- Disciplinary Committee
b. All committees are to be appointed by the executive body of the Association and ratified by the House.
c. All committees shall have one year tenure of office except in cases of ad-hoc committees set up specifically
to deal with issues that are time-bound.

a.The decision to review the constitution must be taken by 50 + 1% of registered members of the Association
in a meeting of the House at any time.
b.The reviewed constitution would be adopted and passed by the same 50 + 1% of
registered members of the Association at any meeting of the House called for that purpose.
